Booking Terms And Conditions

Any booking, whether confirmed verbally, electronically or in writing will be subject to a contract carrying the following terms and conditions. Don't panic, this is easy and is good for both us and all our customers! 


Plus if you actually bother to read it, it's not all legal rubbish, we've added some jokes along the way!


1. Introduction 

1.1 All booking contracts are negotiated between Party.Party Hire Ltd (Trading As: FoamPartyPeople) and our client. In this respect, Party.Party Hire Ltd shall not be held responsible for a breach of this contract not directly caused by our actions (or indeed inactions). Especially if we've screwed up typing it out or added a faulty link or something...


2. Confirming the booking 

2.1 All bookings take effect immediately upon acceptance of the booking by BOTH the client and Party.Party Hire Ltd, whether orally, electronically or in writing ("Confirmation"). 

2.2 The fact that a physical contract has not been signed or returned is not sufficient to invalidate the booking or acceptance of these terms. Unless you or us have a really good reason.....seriously....call or email us if s@#t happens and we'll try and work around it. 

2.3 Party.Party Hire Ltd will store any paperwork for safe keeping (copies of which will be readily available on request) and will continue store the contract between both parties for the period up to and including the Event Date, and for a further period of twelve months. 

2.4 If you book more than one week in advance, Party.Party Hire Ltd request you contact us again within seven days of the event to confirm the full booking details (basically to make sure we've not lost them or anything silly like that).


3. Changes to contract 

3.1 The agreed Total Cost may be subject to change if any details of the Contract are altered (by agreement with both Party.Party Hire Ltd and the client). 

3.2 All changes to the Contract must be arranged and agreed by Party.Party Hire Ltd in advance of the Event Date (again, don't panic over this one - it's there to protect us if someone turns around at the last minute and freaks out about their venue getting covered in foam/gunge/paint....if you book us for a specific event we assume you realise what it will involve before we pitch up and start doing our thing!) 


4. Payment of fees 

4.1 The Total Cost initially quoted is normally exclusive of VAT but includes all our reasonable expenses (including fuel, travel, time and expected consumables). 

4.2 Party.Party Hire Ltd do not require a deposit...normally...unless we google you and read lots of bad things. However we will be upset if we get screwed around either at the last minute (within seven days of the event), after we get there or for busy dates like Bank Holidays, Eve's (New Year, Christmas, etc). If we've taken all reasonable steps and you've met all the criteria of section 2, the full cost will be payable. Check our reputation...we've not missed a booking in 6 years, and even arrived at one with our van on the back of a low-loader after we broke-down en-route....Treat us right and we'll treat you right! 


5. Cancellations by the Client 

5.1 The Client shall have the right to terminate this Contract only in the case of a Force Majeure Event provided that the Client informs Party.Party Hire Ltd as soon as reasonably practicable on becoming aware of the Force Majeure Event. Or sometimes if it's well in advance and it's a really good reason - get in touch and let us know about problems ASAP! 

5.2 It is the Client's responsibility to ensure their venue at the Event Address can accommodate Party.Party Hire Ltd's event and any problems caused due to venue restrictions shall result in the Client being liable to pay the full invoice supplied by Party.Party Hire Ltd. 


6. Cancellation by Party.Party Hire Ltd 

6.1 Party.Party Hire Ltd shall have the right to terminate this Contract only on the occurrence of a Force Majeure Event. 

6.2 Party.Party Hire Ltd shall inform the Client as soon as reasonably practicable on becoming aware of the Force Majeure Event. Party.Party Hire Ltd will make all reasonable attempts to find a suitable replacement event of similar standard, style and cost. Should a suitable replacement not be found (and assuming - as is standard - no deposit has been paid) no invoice will be submitted. As mentioned above, if you're at all worried, check our reputation...we've not missed a booking in 6 years, and even arrived at one with our van on the back of a low-loader....(and we can supply a reference about this incident on request!) Treat us right and we'll treat you right! 


7. Late payment of the invoice 

7.1 Failure by the Client to pay Party.Party Hire Ltd within the terms specified will result in interest being charged on the balance due. Payment terms are normally

  • On or before the day the event finishes for first-time customers.
  • Within seven days of the day the event finishes for new(ish) customers who are Limited companies.
  • Within 14 days of the day the event finishes for regular established customers

Please note these terms are subject to change on an individual basis, depending on circumstances. When we confirm the booking and when we send the invoice, both will confirm the payment terms. 

7.2 Party.Party Hire Ltd reserves the right to claim interest on late payments at 5% above the Bank of England base rate on the date of the event. 

7.3 Non-payment of the Balance will result in legal action and any payment outstanding from the Client outside of these terms may be referred to our recovery company and will be subject to a surcharge of 15% plus VAT to cover collection costs incurred. This surcharge together with all other charges and legal fees incurred will be the responsibility of the Client and will be legally enforceable. 


8. Liability at the event 

8.1 Party.Party Hire Ltd accepts no liability for any accidents, injury or incidents at our events. Whilst our attractions may expose participants to some level of risk, we have controls and risk assessments in place to reduce these as much as possible. At all times the venue (and by extension their staff and the security and/or door-staff employed or provided by them) are responsible for the actions and safety of all members of the public, all members of venue staff and the safety of members of Party.Party Hire Ltd staff. 

8.2 Party.Party Hire Ltd is not responsible for and accepts no liability for anyone suffering accidents, injury or incidents who is participating in our events if they are: drunk and/or on drugs; are disorientated by lighting/smoke effects; are incapacitated in any other way by the venue, it's layout, special effects or their surroundings; or are affected or influenced by other members of the public also participating in the event. 

8.3 Venue/Event staff are at ALL times responsible for four key Health & Safety objectives: 

� the prevention of crime and disorder 
� public safety 
� the prevention of public nuisance 
� the protection of children from harm 

Party.Party Hire Ltd and it's staff can accept no responsibility for these objectives. 

8.4 Party.Party Hire Ltd events require Door Supervisors on the event premises to be registered with the Security Industry Authority (SIA). They must display their badge at all times when they are working. Party.Party Hire Ltd staff will liaise and brief the team-leaders or the teams before the event starts on topics including logistics, event operation, timings, specific and general risk factors and will ensure Door Staff can identify and contact Party.Party Hire (Gunjee.com) staff at all times during the event. 

8.5 Party.Party Hire Ltd require our event area to be correctly secured by the venue and/or it's staff. This may include (but is not limited to) rigid crowd barriers, flexible crowd barriers and permanent barriers AND should also include suitable and permanent placing of door/security staff throughout the event, contact us for more information if required. Party.Party Hire Ltd can accept no responsibility for any accidents, injury or incidents that occur from members of the public entering our secure event area. 

8.6 In the event of any incident during a Party.Party Hire Ltd event, we require access to CCTV footage including (but not limited to) the installation of the event, the operation of the event, any specific incidents occurring before, during or after the event and the pack-down/removal of the event equipment. 

8.7 Party.Party Hire Ltd's contract is with either a promoter or a venue. If the promoter is booking us to work in a venue, or a venue is booking us to work alongside a promoter, all liabilities for any accidents, injury or incidents involving any customers or staff at our event(s) lie with: 

� The Venue (including external Door Staff if applicable) 
� The licencee 
� The Promoter 

Party.Party Hire Ltd will not accept any liability for any accidents, injury or incidents that could have been prevented by these groups' actions or inactions. 


9. Complaints 

9.1 If through our own fault Party.Party Hire Ltd is unable to fulfil part of the event schedule or breaks the terms of this contract and the Client would like to claim a reduction on Party.Party Hire Ltd's fee, a complaint must be made in writing to Party.Party Hire Ltd no more than 30 days after the Event Date. Full payment must still be made to Party.Party Hire Ltd as agreed in the contract. The Client shall not be entitled to set off any discount it feels it is due against the payment of the Total Cost. 


10. Changes on the Event Date 

10.1 Where possible, changes to the contract schedule which are unavoidable on the Event Date should first be discussed and agreed with the Party.Party Hire Ltd. Should changes not be possible due to scheduling conflicts, Party.Party Hire Ltd reserve the right to charge i) the full fee (if proposed new dates clash with existing bookings) or ii) reasonable expenses for staff and consumables (if proposed new dates do not clash with existing bookings but cannot be fulfilled for any other reason). Again, don't worry about this clause - as mentioned above, if you're honest and treat us right and we'll treat you right in return! 

For example, we once had to abandon a night on 'Maundy Thursday' at an unspecified nightclub, but for a small extra fee (and after leaving the primed equipment in place) we came back the next night on 'Good Friday' and we had a great Friday night event instead! 


11. Force Majeure Event 

11.1 A "Force Majeure Event" occurs where a party is unable to comply with its obligations under this Contract for a reason outside of its control (such as war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, accident, civil commotion, national calamity, order of Government or Local Authority having jurisdiction in the matter, changes in law, foreign government policy, act of God) and which is not attributable to any act or failure to take preventive action by us or yourselves. 


11. Videography at our events (by us and you) 

12.1 We video some of our events to sell back to participants via this website, in the Past Events section. This is partly how we keep our event prices low because, indirectly, the media sales subsidise current and future event bookings. We only sell media that has been shot in a controlled area at events such as: 

  • The Dunk Tank
  • The Gunge Tank



12.2 The participants can clearly see that they are being filmed by us. The camera we use is obvious - it's as clear as day (and also it's really heavy, so spare a thought for our cameramen and women!) There are Media Disclaimers in the area where our cameras are filming and all participants are aware they are being filmed. They are also made aware where they can purchase the media of themselves taking part, by way of our banners, disclaimers and T-shirt logos. 

12.3 We do sometimes video other events, such as: 

  • Foam Parties
  • UV Paint Parties
  • Popcorn Parties
  • Snow Parties


These are used for promotional purposes and, in general, the media from these is not sold.

12.4 We always protect people's Right To Privacy and participants can at any time during events ask not to be filmed. We will ALWAYS obey any such requests - also we will always comply with requests from individuals to remove media of them if they later decide they don't want it on our website. We always discourage nudity at out events (often despite DJ requests for such) to protect the licenses of venues we are working in - in addition to which, we would not put such media onto FoamPartyPeople.com. 

A company/venue can always ask us not to video events, but this must be asked for in advance as it would affect our pricing structure.

The media policy detailed above is what Party.Party Hire has always used at all events past and present! 

12.5 Clubs and/or promoters are more than welcome to take photographs and videos at our events. We do ask that we can use these photos and/or videos on our website/social media platforms, and that videos are restricted to promotional style/length clips as opposed to the full-length clips that we film and sell. Where appropriate we will link back to the source of your promotional photos/videos. 

If you are unhappy with this arrangement please let us know at the booking-stage. 

12.6 If you have any further questions about media policies or want to ask us about anything else, please just ask us.

As well as the above terms and conditions, all bookings also fall under the remit of our Media Policy (click above) unless specifically negotiated otherwise....
